The Supreme Court vacation bench while staying the non-bailable arrest warrants pending against Vinod Zutshi (IAS) and Hridesh Kumar Sharma (RAS) felt that the lower courts had misinterpreted the SC order dated October 4, 2012, whereby an order was passed directing the warrant of arrest to be kept in abeyance till the disposal of revision petition.
The apex court vacation bench of Justice Gyan Sudha Misra and Justice Madan B Lokur, while staying the arrest warrant on June 10, also wondered whether the magistrate while taking cognizance of the matter was justified in issuing non-bailable warrant(s). It was noted that Zutshi was a member of the committee of 15 IAS officers, which took the decision regarding the grant of lease to M/s Jal Mahal Resorts Pvt Ltd for developing tourist facilities around the lake. However, case was lodged against Zutshi and Hridesh Kumar even though they were not whole sole authority as the committee was presided over by the chief secretary.
